{"id":5273,"date":"2013-01-18T11:58:02","date_gmt":"2013-01-18T19:58:02","guid":{"rendered":"http:\/\/www.gordon-elias.com\/blog\/?p=5273"},"modified":"2013-04-03T15:11:34","modified_gmt":"2013-04-03T22:11:34","slug":"bnsf-signs-accord-with-osha-protecting-railroad-workers-whistleblower-rights","status":"publish","type":"post","link":"https:\/\/www.gordon-elias.com\/blog\/5273\/bnsf-signs-accord-with-osha-protecting-railroad-workers-whistleblower-rights\/","title":{"rendered":"BNSF Signs Accord with OSHA Protecting Railroad Workers Whistleblower Rights"},"content":{"rendered":"<p>BNSF Railway Co and the Occupational Health and Safety Administration achieved a milestone on Jan, 15, 2013, by signing an accord that protects railroad workers who report on-the-job injuries from retaliation.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-5278\" alt=\"BNSF worker\" src=\"http:\/\/www.gordon-elias.com\/blog\/wp-content\/uploads\/2013\/01\/BNSF-Railroad-worker.jpg\" width=\"481\" height=\"321\" srcset=\"https:\/\/www.gordon-elias.com\/blog\/wp-content\/uploads\/2013\/01\/BNSF-Railroad-worker.jpg 502w, https:\/\/www.gordon-elias.com\/blog\/wp-content\/uploads\/2013\/01\/BNSF-Railroad-worker-300x199.jpg 300w\" sizes=\"auto, (max-width: 481px) 100vw, 481px\" \/><\/p>\n<p><!--more-->Between 2007 and 2012, OSHA received over 1,200 whistleblower complaints by railroad workers higher than for all other whistleblower protection statutes enforced by the agency, except one.<\/p>\n<p>The <a href=\"http:\/\/www.dol.gov\/opa\/media\/press\/osha\/OSHA20130027.htm\" target=\"_blank\">new agreement<\/a> changes the terms of BNSF\u2019s disciplinary policy so on-the-job injuries no longer play a role in determining an employee\u2019s probation following a suspension and disciplinary points will also no longer be issued for injuries as they did in the past.<\/p>\n<p>Assistant Secretary of Labor for Occupational Safety and Health David Michaels said:<\/p>\n<blockquote><p>Protecting America&#8217;s railroad workers who report on-the-job injuries is an essential element in OSHA&#8217;s mission. This accord makes significant progress toward ensuring that BNSF employees who report injuries do not suffer any adverse consequences for doing so.<\/p><\/blockquote>\n<p>IBEW Railroad Department Director Bill Bohne\u2019 said:<\/p>\n<blockquote><p>It\u2019s been a serious problem with the railroads for years.
